As a result of the inspection it was reported that it did not comply with SCH TL, Part C Art. 11.9 (3) as the combustion chamber did not comply with the relative diagram. Mike Clements was at the hearing and was able to adequately quantify the measurement methods used and measurements recorded. Ron McMillan was not able to attend but provided a document that supported Mike's evidence. The head, at the request of your engineer supplier, was also independently measured by Taylor Automotive. These measurements supported those recorded by MSNZ Technical Officers. It was established that the measurements were in excess of those on the diagram in Sch TL, part G that relates to Article 11.9 (3). The measurements were accepted by you. It was also established that the head was supplied by a thrid party and it is accepted that your team undertook no machining modification work on it. A submission and supporting argument was also received regarding the appropriate penalty and whether or not the standard penalties can apply to a Championship. These arguements have also failed as Sch P 2.1 (3) requires that in all cases the standard penalty shall be applied. The exceptions to this are clearly marked, however the offence in this case does not fall within their parameters. There is no provision for me to go outside these requirements. Penalty CH 40.11.3 is clearly designed to be used over a championship season and in situations such as this. A written statement from Barry Carrington Championship Scrutineer, confirms that the engine ID with seal was fitted on 7 Nov 2011 and used at Rounds1-6. You confirmed this and that you had not had an engine change during the series. | The Event Director rules that Penalty CH 40.11.3 applies. $600 fine.
